Terms and Conditions (Public Offer Agreement)
for the Provision of Medical Facilitation Services by Sunrise HealthTrips

 

 

1. General Provisions

1.1. This document constitutes a public offer of Sole Proprietor Nataliia Fedevych (Group 3) (hereinafter referred to as the “Service Provider”) to enter into an agreement with any natural person (hereinafter referred to as the “Client”).

1.2. This Offer is binding and addressed to an indefinite number of persons.

1.3. Full and unconditional acceptance of this Offer shall be deemed to occur upon the Client performing any of the following actions: payment for services, submission of an application via the website or other electronic channels, or confirmation of consent by selecting the appropriate checkbox. Such acceptance shall have the same legal effect as signing a written agreement.

1.4. The date of conclusion of the Agreement shall be the moment of acceptance.

1.5. This Agreement is concluded remotely and does not require a handwritten signature or a qualified electronic signature (QES).

1.6. The terms of this Agreement are identical for all Clients.

 

 

2. Subject of the Agreement

2.1. The Service Provider renders medical facilitation services (informational, advisory, and organizational support for the Client in interactions with medical institutions), including but not limited to:

informational selection and proposal of at least two medical institutions and physicians in accordance with the Client’s request;

organization of obtaining a second medical opinion from independent medical institutions;

coordination of communication between the Client and medical institutions;

informational and organizational support of the Client until the commencement of treatment and during the stay at a medical institution;

assistance in organizing travel, including support in selecting transport options (air and bus transportation), without providing transportation services.

2.2. The Service Provider is not a medical institution.

2.3. Medical services are provided exclusively by independent third parties (medical institutions and physicians) who are not in employment or controlled partnership relations with the Service Provider. The Service Provider does not influence medical decisions and bears no responsibility for their outcomes.

2.4. The Service Provider is not a party to any agreements between the Client and insurance companies or other third parties.

 

 

3. Cost of Services

3.1. The Client shall pay:

Support and coordination — UAH 1200;

Document translation — UAH 600, regardless of the number of pages.

3.2. Payment shall be made in advance.

3.3. The Service Provider may receive remuneration (commission) from medical institutions or partners for organizing interaction with the Client. Such remuneration does not affect the cost of services for the Client and does not create any additional financial obligations for the Client.

3.4. Payment confirms the conclusion of the Agreement.

3.5. Payments are non-refundable after the commencement of service provision.

 

 

4. Procedure for the Provision of Services

4.1. Services are provided remotely.

4.2. The Client shall provide complete and high-quality documentation.

4.3. A second medical opinion shall be provided within up to 72 hours, provided that the Client submits a complete set of medical documents, including all available test results, medical conclusions, discharge summaries, and other relevant information, in the form of clear and legible scans or photographs without cropped parts, with visible details, and subject to the absence of additional requests from physicians or medical institutions.

4.4. Timeframes may be subject to change.

 

 

5. Rights of the Service Provider

5.1. To update the terms of this Offer by publishing a new version on the website; such new version shall enter into force upon publication unless otherwise specified;

5.2. To independently determine and modify the list of medical institutions, physicians, and other third parties involved in the provision or organization of services;

5.3. To engage third parties (including translators, coordinators, medical consultants, and partner organizations) to fulfill obligations under this Agreement;

5.4. To suspend or refuse the provision of services in the event of:
(a) provision of incomplete or inaccurate information by the Client;
(b) impossibility of service provision due to objective reasons beyond the Service Provider’s control;
(c) violation by the Client of the terms of this Agreement;

5.5. To terminate cooperation with the Client at any time if further provision of services becomes impossible or impractical due to objective professional reasons.

 

 

6. Obligations of the Client

6.1. The Client undertakes to provide complete, accurate, and up-to-date information necessary for the provision of services; to independently make all decisions regarding the selection of medical institutions, physicians, and treatment methods; and to acknowledge that the services of the Service Provider are purely informational and organizational in nature and do not constitute medical services.

 

 

7. Liability

7.1. The Service Provider shall not be liable for any medical decisions, including but not limited to diagnosis, selection and administration of treatment, its outcomes, possible complications, or for the actions, errors, or omissions of medical institutions, physicians, or other medical personnel.

7.2. The services provided are of an organizational nature.

7.3. Liability of the Service Provider shall be limited to the amount of payment made by the Client.

 

 

8. Force Majeure

8.1. Force majeure circumstances shall include events beyond the reasonable control of the Service Provider, including but not limited to: military actions, emergencies, technical or infrastructure failures, or limited availability of services.

 

 

Final Provisions

The Client confirms full understanding and acceptance of the above-stated terms of this Agreement.
